Under and by virtue of an Order of the Clerk of Superior Court of Montgomery County, North Carolina, entered on the 5th day of July, 2019.  In this Special Proceeding entitled GREGORY L. BLAKE, Administrator of the Estate of THELMA G. GARNER, Deceased , Petitioner, v. MARTHA BYRD COBLE, MT. GILEAD FIRE DEPT. and HOSPICE OF STANLY CO., Respondents, the undersigned, was by said Order appointed Commissioner to sell the lands described in the petition and amended petition, and will on the 20th day of August, 2019 at 12:00 P.M. at the Courthouse, in Montgomery County, North Carolina, offer for sale to the highest bidder for cash, those certain tracts or parcels of land lying and being in Mt. Gilead Township (Tract One) and Mt. Gilead Township (Tract Two), Montgomery County, North Carolina and more particularly described as follows:

 

TRACT ONE:

Those two certain tracts of land which comprise the J. E. Dawkins’ homeplace in Mt. Gilead, North Carolina, less lands thereafter conveyed, which said tracts may be more particularly described in a deed dated 9/1/44 from Mary C. Scarboro, et vir, to J. E. Dawkins, recorded in Book 91, page 488, Montgomery County Registry, and in a deed dated 10/23/44, from F. M. Scarboro and wife, Riller Scarboro, to J. E. Dawkins, registered in Book 93, page 221, Montgomery County Registry, less a tract of land 10 feet by 290 feet off of the west side thereof conveyed W. M. McNeill and wife, Saima J. McNeill, by deed of the grantors and grantees dated 9/10/73.  This tract may be more particularly described as follows:  BEGINNING at a stake on Allenton Street, the N. W. corner of the Dawkins tract; thence, South 293 feet; thence, East 140 feet to a stake; thence, North 110.6 feet to a point in the Dawkins line, marked with a stake; thence 8.1 feet East to an iron stake; thence North 2 degrees 48 minutes West 182.54 feet through the garage wall to the Dawkins stake in the South side of Allenton Street; thence, West 140 feet to the BEGINNING.

This property was conveyed the grantors by deed of J. E. Dawkins, Jr. and wife Edna Frances Dawkins, single, who with Mary Lou Dawkins Lewis, were the sole heirs at law and next of kin of J. E. Dawkins, deceased.

TRACT TWO:

Lying and being in the Town of Mount Gilead being the lot deeded by R. W. Steele to Mrs. R. D. Downer on the 21st day of December, 1918, and more particularly described as follows, to wit:

Adjoining the Norfolk and Southern Railroad and C. W. Taft Estate  and bounded on the East by North Main Street, on the South by Norfolk Southern Railroad and on the North and West by the C. W. Taft Estate property, the same known as the C. W. Wooley lot and deed to G. R. Downer by R. E. Hamlet, Commissioner, July 4, 1919.

For title reference see deed from W. E. Haywood et al to Bernice Ingram dated January 7, 1936, and recorded in Book 88, Page 221, Montgomery County Registry.

The above-described property will be sold subject to any liens or encumbrances, including unpaid county and city ad valorem taxes, including those for the year 2019, and also city assessments, if any.

An earnest money deposit equal to five percent (5%) of the bid price or a minimum of $750.00, whichever is greater will be required from the highest bidder at the time of sale as evidence of good faith.

This sale will be held open for ten (10) days for upset bids.
