PAUL A. MCLENDON and

RACHEL M. MILLER,Respondents.

Under and by virtue of an Order of the Clerk of Superior Court of Montgomery County, North Carolina, entered on the 21st day of December, 2016, the undersigned, was by said Order appointed Commissioner to sell the land described in the petition, and will on the 25th day of January, 2017 at 12:00 o’clock Noon at the Montgomery County Courthouse in Troy, Montgomery County, North Carolina, offer for sale to the highest bidder for cash, that certain tract or parcel of land lying and being in Biscoe Township, Montgomery County, North Carolina and more particularly described as follows:

Fronting on the Highway extending from U.S. 220 towards J. R. Maness’s.

Beginning at an iron stake in the McCaskill line, which said iron stake is 410 feet N. 21 E. from the Southeast corner of the tract of land purchased by the parties of the first part from W. L. Currie, et al and runs thence with the McCaskill line N. 21 E. 210 feet to the iron stake; thence N. 84-30 W. 470 feet to an iron stake in the East edge of said highway; thence S. 13-10 W. 202.7 feet to an iron stake; thence S. 84-30 E. 441.1 feet to the beginning, containing 2.1 acres, more or less, according to survey made by C. Hafer, surveryor, dated March 12, 1946.

The above-described real property will be sold subject to any liens or encumbrances, including unpaid county and city ad valorem taxes, including those for the year 2016, and city assessments, if any, and subject to the approval of the Clerk of Superior Court.

An earnest money deposit equal to five percent (5%) of the bid price or a minimum of $750.00, whichever is greater will be required from the highest bidder at the time of sale as evidence of good faith.

This sale will be held open for ten (10) days for upset bids.
